Preface

In the knowledge economy era of the 21st century, the development of new technology and the rapid development and changes in politics, economy, and trade have made traditional judicial science unable to respond to modern social transactions which are complicated and diverse. Economic and financial law provides important legal regulations for economic development and thus is closely related to the rights and benefits of enterprises and people. Professional knowledge about such economic and financial law issues as intellectual property right, technology law, WTO, and tax litigations has become more important. These issues are more complicated than traditional judicial science and can not be covered by traditional judicial science. Neither can they be solved by traditional judicial science. In response to these emerging economic and financial law fields, experts specialized in economic and financial law are needed to conduct research and to solve all the difficult problems we face today. In addition, the establishment of the Department of Economic and Financial Law and the Graduate Institute of Economic and Financial Law responds to the increasing demands for economic and financial law experts by industries and businesses. The government has loosened its policy on investments in China by Taiwanese businesses, and the cross-strait trade has grown. Therefore, industries and businesses have increased their demands for experts specialized in investment in China and business law.

Brief History of the Department and Graduate Institute

In response to the high demands for economic and financial law, in 2002 National Chung Cheng University separated the Division of Economic and Financial Law from the Department of Law and established the Department of Economic and Financial Law. It was expected that in combination with the existing Graduate Institute of Economic and Financial Law, the establishment of the new department could form a complete education and research system on economic and financial law to educate experts that have professional knowledge in economic and financial law. Therefore, in addition to traditional basic law courses, our department (graduate institute) lays emphasis on four important areas: (1) business law, (2) international economic law, (3) intellectual property rights law, and (4) taxation law to respond to the needs of the government and the private sectors and respond to the problems of local and international economic and financial law which may arise in the wake of international competition pressures after Taiwan is acceded into WTO so as to elevate the ability of Taiwan government and enterprises to complete in international markets. It is also our expectation to go in step with economic and financial law in advanced countries. Currently our department (graduate institute) has seven full-time teachers, including three professors, three associate professors, and one assistant professor, all of whom have a doctorate and whose specialties cover Constitutional law, commercial law, economic and financial law, intellectual property law, international trade law, and international economic law. Our department has 198 students (173 undergraduate and 25 graduate). When the undergraduate students graduate with a degree, they and graduate students are eligible to sit in the judge qualification exam, the bar exam, and other national exams.

Prospects

In view of the thriving development of domestic and foreign economy and technology and in response to the increasing needs for domestic and foreign experts in economic and financial and technology law, the government has placed emphasis on the cultivation of excellent experts in economic and financial and technology law. Business groups have also established their law department or expanded their existing one, and recruited more experts in economic and financial law and given them more authorities and responsibilities. So to educate more excellent professionals in economic and financial and technology law in larger numbers is really needed by the government of Taiwan and business operation. It is also the only way to protect rights and benefits and elevate their competitiveness.

Characteristics of Instruction

1. The instruction of the department (graduate institute) aims to train flexible logical thinking of judicial science and to educate law professionals that have interdisciplinary specialties covering economy and finance and technology.

2. The instruction of the department (graduate institute) emphasizes both theory and practice. Beyond classroom instruction, the students participate in internships at law firms, legal consultation service at legal service organizations, and take up service activities in summer and winter vacations at courts of law or government offices.

1. To cultivate professionals specialized in economic and financial law and law of technology and judicial administrators is the main objective of the Department of Economic and Financial Law.

2. To cultivate senior professionals in economic and financial law that can respond to national economic development, technological advancement, and business operation needs is the main objective of the Graduate Institute of Economic and Financial Law.
