Abstract

Gambling still exists in human societies after thousands of years’ prohibition; one could perceive that its existence is needed. There are even scholars who want to remit legal punishments for gambling. Hence, it explains a viewpoint that says the intrinsic nature of gambling is not sinful. On the other hand, criminal acts, which derived from gambling, have bothered the ruling government repeatedly. These atrocities cause gambling to take the blame for their infamy; and thus, be banned by the authorities.

Casinos started due to economic factors; they brought lots of wealth and prosperities to local government and private enterprises in recent years. Issues such as: “What effect does casinos have on local criminal acts?” “Is there a direct causality between these two?” “What are their connections to each other?” are quite conspicuous. This research focuses its main objects on general public, police officers, scholars, and professionals. Questionnaires regarding characteristics of opening gambling to certain people, changes in crime percentage after establishments of casino, subjects and objects of criminalities, allocations of police resources and budgets, extent of impacts on social customs, selection of casino’s locations, values of such establishments, difficulties between finance and crime, and trend of local public opinions were sent out to the above-respondents people. As a result, one is able to explore out the relative conditions of establishing casino in Taiwan, and clarify connections between casinos and crime. Not only does this paper put forward conclusions of the research,but it also derives recommendations for those organizations concerned in this issue.

觀光賭場開放設置與犯罪關聯性之調查研究

賭博行為歷經千年的禁制仍存在於人類社會，可見其存在有其需求性，甚者，更有學者提出將賭博行為除罪化之說，由此可說明了賭博本質不為罪的觀點。然而，賭博所衍生出來的犯罪行為卻一再地困擾著執政當局，也使得賭博行為必須為此背負著沈重的罪惡污名而為執政者所禁制。

近年來，隨著經濟因素所發展而成的觀光賭場（casino），為當地政府帶進不少的財富，也為當地的民間事業帶來了一片欣榮的景象，究竟這些觀光賭場設置後對當地或該國整體的犯罪現象有何影響，其與犯罪的發生是否可成為直接的因果關係，又兩者之間所產生的關聯性為何，都引人關注。本研究乃以問卷調查的方式，並以一般民眾、警察人員及學者專家為調查對象，針對開放賭博對象的特性、設置後之犯罪率變化、犯罪行為的主客體、警力與預算配置、社會風氣影響程度、設置區位選擇、設置之價值、財政與犯罪之兩難及當地民意趨向等為研究變項進行調查，從而瞭解台灣地區設置觀光賭場的相關條件，並說明開放設置觀光賭場與犯罪之關聯性，據以提出研究結論與相關建議供有關單位參考。
